Terms of Service

These terms govern your use of cadencesignals.com (the "Service"), operated by Berto Production (Andrea Bertolotti), NIF Y-4514/312-R, Alicante, Spain ("we", "us"). By creating an account or using the Service you accept them. If you do not accept them, do not use the Service.

1. What we provide

The Service publishes general market commentary and hypothetical trade ideas produced with AI assistance, together with a public record of how those ideas turned out on a simulated account. It is an information and education service and nothing more. See the Risk Warning and the Recommendation Disclosure, both of which form part of these terms.

We do not provide investment advice, portfolio management, order execution, brokerage or any other regulated investment service, and we are not authorised by the CNMV, CONSOB, the FCA or any other financial regulator.

2. Beta

The Service is currently in beta and free of charge. It may contain errors, may change without notice, and may be interrupted, restricted or discontinued at any time. Features may be added or removed. We may introduce paid plans in the future; if we do, we will tell registered users in advance and no charge will ever be applied without your express prior consent.

3. Who may use it

To open an account you must:

be at least 18 years old and have the legal capacity to enter into a contract;
use the Service for your own personal, non-professional purposes;
not be resident in, or accessing the Service from, a country where receiving this kind of content, or trading the instruments discussed, is prohibited or restricted; and
not be subject to EU, Spanish, UK, UN or US sanctions.

It is your responsibility to check the rules that apply where you live. We make no representation that the content is appropriate or available for use in any particular jurisdiction. The Service is not directed at persons in the United States and is not an offer of securities anywhere.

4. Your account

Give accurate registration details and keep your email address current.
Keep your password confidential. You are responsible for everything done through your account. Tell us at once at info@cadencesignals.com if you suspect unauthorised access.
One account per person. Accounts are personal and may not be shared, sold or transferred.
You may close your account at any time from your account page.

5. What you may not do

Republish, resell, redistribute or make available to third parties the ideas, levels or content of the Service, whether free or for payment, including in signal groups, chat channels or copy-trading services.
Scrape, crawl or automatically extract content, or attempt to bypass the registration gate.
Present our content as your own, or as advice you are giving to someone else.
Interfere with the security or availability of the Service, or use it to send unsolicited messages.
Use the Service to break any law that applies to you, including market abuse rules.

We may suspend or close an account that breaches these terms, without refund where a paid plan exists.

6. Intellectual property

All content on the Service — text, layout, code, methodology and the published record — belongs to Berto Production or its licensors. You get a personal, non-exclusive, non-transferable, revocable licence to view and use it for your own purposes. Quoting a short extract with a visible link back to cadencesignals.com is permitted; systematic reproduction is not.

7. Liability

The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, timely, or that any idea, figure or statement is accurate, complete or current.

You make your own trading decisions. To the fullest extent permitted by law, we are not liable for any trading loss, lost profit, lost opportunity, or any indirect or consequential loss arising from your use of, or reliance on, the Service — including losses caused by an idea being wrong, delayed, undelivered, incomplete, or based on inaccurate data. Where liability cannot lawfully be excluded, it is limited to the amount you have paid us in the twelve months before the event giving rise to the claim (during the beta, that amount is zero).

Nothing in these terms excludes or limits our liability for fraud, for wilful misconduct or gross negligence, for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under Spanish law or under the mandatory consumer protection law of your country of residence.

8. Third-party links and data

Market data and any linked third-party sites are outside our control. We are not responsible for their content, accuracy or availability.

9. Personal data

We process personal data as described in our Privacy Policy and Cookie Policy.

10. Changes to these terms

We may update these terms. Substantive changes will be announced on the site and, for registered users, by email at least 15 days before they take effect. If you do not accept the new terms, close your account before that date; continuing to use the Service after it means you accept them.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these terms, if required by law, or if we discontinue the Service. Clauses 6, 7 and 12 survive termination.

12. Governing law and disputes

These terms are governed by Spanish law. If you are a consumer, this choice does not deprive you of the protection of the mandatory rules of the country where you live, and you may bring proceedings in the courts of that country. Otherwise the courts of Alicante, Spain have jurisdiction.

If you have a complaint, write to info@cadencesignals.com and we will reply within 30 days. EU consumers may also use the European Commission's Online Dispute Resolution platform.
